and i guarantee you it's one of the first times a devout mormon has ever used the word oh [bleep] sake. >> bret: oh dear, thanks for inviting us into your home tonight, that's it for "special report," fair, balanced and unafraid. remember "special report" online coming up right now. >> shepard: this is "the fox report." tonight, women in combat. all of a sudden the outgoing pentagon chief set to lift the two decades' old ban on women serving on the front lines. plus, after months of delays, secretary clinton testifies on bernanke. -- benghazi. >> we had no doubt there were terrorists militants they killed our people. >> we were mislead there were supposedly protests and something sprang out of that, an assault sprang out of that. >> with all due respect, the fact is we had four dead americans. was it because of a protest or guys out for a walk one night who decided they would go kill some americans.

what the difference at this point does it make? >> shepard: secretary clintons testifying for the first time about the attack in libya. and facing fierce criticism. >> i'm glad that you're accepting responsibility. i think that ultimately with your leaving you accept the culpability for the worse tragedy since 9/11. i really mean that. >> shepard: tonight, her responses, the emotional moments. >> i put my arms around the mothers and fathers, the sisters and brothers and sons and daughters. >> shepard: and what we still do not know about the attack in benghazi. >> shepard: that is first from fox this wednesday night for five and a half hours today. secretary of state hillary clinton jousted with house and senate lawmakers during two separate hearings. she answered criticism and tried to settle questions about what really happened with that attack in benghazi. the assault on september 11th of last year killed the u.s. ambassador to libya, chris stevens and three other

americans. an independent panel later blamed systemic failures for what it calls grossly inadequate security at the u.s. outpost. secretary clinton today she takes responsibility for what happened. lawmakers in both the house and the senate command demanded to know why she wasn't more involved in getting additional security to benghazi before the attack. >> when did you become aware of master stephens request and how did you respond to it? and did he ever personally ask you be involved? >> no. and -- no. any of the requests -- any of the cables having to do with security did not come to my attention. >> had i been president at the time, and i found that you did not read the cables from benghazi, you did not read the cables from ambassador stephens, i would have relieved you of your post. >> shepard: other lawmakers were critical of u.s. ambassador to the united nations susan rice and how in the aftermath of the attack she characterized it as a spontaneous protest.

>> the american people deserve to know answers and they certainly don't deserve false has answers. and the answers that were given the american people on september 15th by the ambassador of the united nations were false. >> shepard: in fact, intelligence officials have said they gave ambassador rice those talking points, the ones she used on five sunday shows and they took out references to al qaeda. and secretary clinton said today those who have accused ambassador rice of misleading the american people are wrong. we also got a sense of how this attack may have affected secretary clinton personally. during her opening statement, before the senate this morning, her voice wavered as she described comforting those who lost their loved ones. >> for me, this is not just a matter of policy, it's personal. i stood next to president obama as the marines carried those flag-draped caskets off the plane at andrews. i put my arms around the mothers and fathers, the

sisters and brothers, the sons and daughters and the wives left alone to raise their children. >> shepard: but, perhaps, the most contentious moment of the day between secretary clinton and the republican senator ron johnson. >> we were mislead that there was supposedly protests and something sprang out of that, an assault sprang out of that. and that was easily ascertained that that was not the fact and the american people could have known that within days and they didn't know that. >> with all due respect, the fact is we had four dead americans. >> i understand. >> was it because of a protests or guys out for a walk one night and decided they would go kill some americans. what difference, at this point, does it make? it is our job to figure out what happened and do everything we can to prevent it from ever happening again, senator. >> shepard: the new jersey democrat bob menendez presided over today's hearing in the senate. he said he was satisfied with secretary clinton's responses. >> i think she answered for two and a half hours forth rightly, thoroughly,

thoughtfully, and i think that there are those who may have disagreements, but, at the end of the day, no one can question, i think, the truth, veracity and depth of thoughtfulness that the secretary answered >> shepard: remember the first scheduled hearing on benghazi happened in november without secretary clinton who was away on a trip. lawmakers cancelled another set of hearings last month after secretary clinton got a concussion and suffered a blood clot. so this extraordinary day has been months in the making. and we have team fox coverage of the benghazi hearings. catherine herridge covering the ongoing threats from terrorists. first, let's get to mike emanuel on capitol hill. mike, in the late afternoon session and late in the day, some fireworks on the house side. >> shep, that's right. there was some bickering back and forth with democrats saying that funding for embassy security has been inadequate. republicans responded saying "you should spend your money on security and not on other things such as climate

change." then there was this moment: >> there was a request made for more security and it was denied on june 7th. and so, madam secretary, you let the consulate become a death trap, and that's national security malpractice. you have said you take responsibility, what does responsibility mean, madam secretary? you are still in your job and there are four people at the department of state that have culpability in this that are still in their jobs. >> clinton says she takes responsibility but congressman duncan notes that some heads should have rolled, shep. >> shepard: we repeatedly heard questions today, mike, about why secretary clinton didn't speak directly with those who were investigating this attack. >> that's right. the accountability review board as it was known essentially said that blame should stop at the assistant secretary level, just below senior management at the state department so today, secretary clinton was asked if she spoke to the investigators.

>> i was not asked to speak with the accountability review board during their investigation. the specific issues they were looking at regarding the attack on benghazi were handled by security professionals in the department and that's where they are focused. obviously, if they had thought that i was relevant or would have had information that would have helped the investigation, i would have gladly discussed that with them at their request. >> this was likely hillary clinton's final visit to capitol hill as secretary of state with senator john kerry awaiting confirmation to replace her. shep? >> shepard: mike emanuel on capitol hill this evening. well, secretary clinton says terrorists used weapons from libya in last week's attack at a gas plant in algeria. militants there killed three dozen hostage, three americans among them, according to algeria's prime minister. >> so, this pandora's box, if you will, of weapons coming out of these countries in the

middle east and north africa is the source of one of our biggest threats. there's no doubt that the algerian terrorists had weapons from libya. >> shepard: and secretary clinton says the u.s. has to do a better job of tracking and recovering those weapons. team fox coverage continues now. catherine herridge at the state department. catherine, secretary clinton also said we have to pay more attention to the threat from terrorists in north africa, which you have been telling us really here for months. >> well, shep, secretary clinton said publicly today what intelligence officials have been saying privately that the libyan weapons are fueling the instability in north africa. today secretary clinton making a direct link between the libyan weapons and the algerian hostage crisis last week that killed a handful of americans. what we heard from clinton today, citing these images from the site intelligence group this is really more evidence that al qaeda in north africa does possess the libyan weapons and that al qaeda is not dead. that the next front is in north africa. secretary clinton also asked

about an august 16th classified cable first reported by fox news that summarized an emergency meeting where the staff on the ground in benghazi told her office that they could not defend against a coordinated attack. >> an emergency meeting was held and a cable sent out on august 16th by the ambassador himself warning what could happen. and this cable went unnoticed by your office. >> the august 16th cable stated that secretary requests for benghazi would be forth coming. the rso in benghazi submitted to tripoli a preliminary list of proposed secretary recommendations on august 23rd but no requests were submitted to washington before the attacks. >> that cable also told the office here in washington, d.c. that the islamists and the weapons were everywhere secretary clinton said, that she had not seen it nor could she say who in her office had reviewed it or even denied those requests, shep. >> shepard: what are you

learning about this apparent transfer of weapons? >> fox news reported that on september 6th, about a week before the attack, a libyan flag vessel called the alantarzar had arrived in turkish support 60 miles from syria reportedly carrying heavy weapons including sa 7's bound for the rebels in syria. >> is the u.s. involved with any procuring of weapons, transfer of weapons, buying, selling, anyhow transferring weapons to turkey out of libya? >> to turkey? i have to take that question for the record. nobody has ever raised that with me. >> it's been in news reports that ships have been leaving from libya and that they may have weapons and what i would like to know is the annex that was close by, were they involved with procuring, buying, selling, obtaining weapons and were any of these weapons being transferred to other countries? any countries, turkey included? >> well, senator, you will

have to direct that question to the agency that ran the annex. >> that agency is a reference to the annex and the cia that was running it. a source on the ground who was working the weapons issue told fox news that they believed ambassador stephens was in benghazi to help facilitate a weapons transfer, these sa 7's. the shoulder-fired missiles out of the hands of extremists, the state department did not deny fox news reporting but seemed to dismiss it. this one data point may suggest why ambassador stephens was in such a volatile region because he had very important mission on such an important anniversary, shepard. >> shepard: catherine herridge at the state department tonight. a step toward equality on the battlefield tonight as the pentagon prepares to lift restrictions on women in combat. as the defense secretary leaves, that's his gift, we will tell you about the new plans for women at war and why some women say it really might not be such a good idea. that's ahead from the journalists of fox news on this wednesday fox report.

new to the necessities of war the pentagon has allowed some exceptions. medic, military police and the like. this new decision which was already recommended by the joint chiefs of staff, we could one day see women in elite commando units. jennifer griffin works the pentagon with us and is is there tonight. how many jobs would now be open to women, jennifer? >> shep, this new directive will open more than 230,000 jobs to women in the army and marines. secretary panetta plans to lift the military's ban on women serving in combat opening thousands of front line combat positions to these women. the ban has been in place since 1994. the service chiefs have until

january 2016 to seek exceptions to certain units, shepard. >> shepard: what have recent tests shown? the physical limitations? can women do this? >> well, remember last october, the marines took the unusual step of opening up a one of their key courses, it's called the marine infantry officer course. two female marines were allowed to go through quantico's marine infantry officer course. it's a brutal 10 week test that requires strength, endurance and fitness, they both failed. marine captain who served in iraq and afghanistan garnered attention last year when she argued against putting women in combat, writing in the marine corps times quote get over it. we are not all created equal. >> i found that i broke down and had muscle atrophy and weight loss at a much faster rate and noticeable weight than my male marines. i found myself tripping constantly. my legs buckling.

falling during fire fights. >> an announcement is expected by the secretary of defense and the chairman of the joint chiefs tomorrow, shepard. >> shepard: jennifer griffin at the pentagon. jennifer, thank you. well, it's a good week for the top u.s. commentator in afghanistan general john allen because is he officially back on track for a promotion. yesterday we reported the pentagon cleared general allen of any wrongdoing in the scandal that ended general david petraeus' career at the cia. investigators had been looking into hundreds of emails that they say general allen sent to a tampa socialite. one who was involved in the petraeus scandal. but after investigators cleared general allen, the pentagon released a statement saying the defense secretary has complete confidence in his leadership. and hours ago, the white house said it will move forward with general allen's nomination to become the next commander of nato. fighting fires always dangerous and when you are trying to do it in the brutal cold, it can be much tougher. would you look at that? we'll show you how chicago firefighters went up against one of the largest fires they

>> fox weather alert, 36 degrees below zero. that was the temperature this morning in northern maine, so cold that if you poured a glass of water out the window, the meteorologists say it would likely freeze before it hit the ground. the bitter weather there part of antarctic blast that was teeth shattering chattering down the new york coast. here in new york city it's expected to be the coldest week in five years. that's causing some real problems for victims of super storm sandy. believe it or not, some of those folks still have no heat, no power in their homes. including this man in new jersey who has yet to receive any aid and is now living in a

trailer next to his house. authorities in several american states are already blaming the weather for multiple deaths. schools are closed all over the place. commuter trains and subways jammed. and let's not forget about the frozen pipes and the water mains. take a look at this. chicago firefighters before dawn had to battle a warehouse fire. one of the biggest they have had in years. but the water froze right on to the side of the building. the conditions so bad, look at this. a third of the department had to help put it out. they even had to bring in empty city buss so firefighters with frozen gloves like this guy had a place to try to get out of cold. incredible. steve brown our chicago-based correspondent with more on the deep freeze. the number of deaths appears to be rising tonight. >> yeah. we're across the street from that warehouse fire that you mentioned during the intro and, yes, tonight news that a chicago suburban newspaper the daily herald say there may be as many as 7 cold related deaths just in the chicago

land area alone. up in green bay, got confirmation of another cold related death. a 38-year-old man found in his driveway on monday. the cause of death severe hypothermia. now, the severe cold conditions up in green bay prompting a truce between the city officials and the saint john the evangelist shelter. this shelter had been sighted multiple times overnight for housing more men than allowed in the permit. the men at the shelter is the way they make it enemy morning. >> if saint john's wasn't here, a lot of these people wouldn't have nowhere to go and there would be more people dying out in the streets or something. >> now the city officials, the city attorney specifically says that he will no longer be serving them with more citations as long as the cold is as cold as it is up there. and, of course, throughout the region. shep? >> shepard: steve brown in chicago tonight. steve, thanks. secretary of state hillary clinton tells congress why she did not go on the sunday talk shows five days after that

saved a puppy's life is reported scheduled forever surgery tomorrow. that dog should be ready for a new home within weeks. last night we told the story of little sophie here a 2-year-old dog from rancho santa fe, california. she had been playing with a puppy in her owner's backyard when a coyote attacked that pup. as the story goes sophie fought off the coyote and nearly died doing it a veteran is scheduled to do more work on a wound to her neck. the dog's owners say the wildlife in their area makes it really too dangerous for them to keep the animals so they put them both up for adoption. the puppy has already found a new home, awe. if you are interested in adopting sophie, join the crowd. contact the helen woodward animal center at the number on the bottom of the screen here. or you can visit the adoption web site animal center.org. in an as you that i havian courtroom today a suspect entered and pleaded for mercy or bleed, i guess because it

showing the goat going through the police report as they prepared that case. of course. i'm shepard smith. this is the fox report. it's the bottom of the hour and the time for the top of the news. secretary of state clinton says going on the sunday talk shows is not my favorite thing to do. she testified on capitol hill today about why she did not do the sunday shows. five days after the attack on the outpost in benghazi. >> i haven't been on a sunday show in way over a year. it isn't something that i normally jump to do. i did feel strongly that we had a lot that we had to manage, that i had to respond to, and i thought that one should be my priority. >> shepard: as we reported at the top of this newscast, some republicans have criticized u.n. ambassador susan rice for her comments on those sunday shows but intelligence officials say they gave her the talking points. today, the white house blasted

what it calls a political obsession over those talking points. ed henry is live at the white house for us tonight. ed, did secretary clinton shed any light on the administration's efforts to save the four who died in benghazi? >> that's one of the looming questions still people are wondering about this story. and she did try to give some new details about those desperate hours after the initial attack on september 11th of last year. and what people at the state department here at the white house and elsewhere in the administration were trying to do to save those americans. take a listen. >> i participated in a secure video conference of senior officials from the intelligence community, the white house and dod. we were going over every possible option, reviewing all that was available to us any actions we could take. >> the dod, of course, the department of defense and the bottom line from the secretary at points she was emotional about these four americans who died she was defiant at other

points about the idea that the administration did not do enough but her bottom line was that they tried to get military assets there to ben gauze to save these americans and they just got there too late, shep. >> shepard: republicans focusing on any involvement the president may have on the night of those attacks? >> i talked to the president he pledged that they would turn over any information that was relevant to this. after the secretary testified today, that there was that secure video conference, i asked jay carney, the white house press secretary, if the president was on that secure video conference, what role he did have on that night of september 11th. carney basically said he didn't have all of those details republican senator john mccain today at this senate hearing was blistering in terms of these questions. take a listen. what was the president's activities during that seven hour period? on the anniversary of the worst attack in american history september 11th, we didn't have the department of

defense forces available for seven hours. two brave americans died in the last hour. >> now, one other question that is still remains after these hearings today is whether or not the white house can claim that al qaeda has been disseminated when clearly the terrorist group is still launching attacks in northern africa and elsewhere. the secretary answered that by saying we have taken out the core leadership like usama bin laden. can you kill the leader and their affiliates just seem to keep growing, shep? >> shepard: ed henry at the white house. thanks. it looks like the u.s. government will indeed be able to keep paying the bills at least for a few more months. the house of representatives today voted to raise the debt ceiling until the middle of may. senate democrats say they will pass the bill soon and the white house says president obama will not veto it. the debt ceiling is the limit on how much the feds can borrow. republican leaders were refusing to raise it without an equal amount of spending cuts. but the bill they just passed has a new ultimatum for the

house and the senate. no budget, no pay. carl cameron in the d.c. newsroom tonight. how is this supposed to break the gridlock? >> hey, shep. it's basically a two-part deal. the first says by april 15th, both the house and the senate each have to pass a budget that balances in 10 years. should either chamber fail then its members paychecks can't be delayed. they can't stop it constitutionally they have to get paid. the other part suspends enforcement of the federal debt limit until may 19th, at which point it will increase retroactively without any offset in spending cuts. here is how speaker john boehner summed it up today. >> you know, the premise here is pretty simple. it says that there should be no long-term increase in the debt limit until there is a long-term plan to deal with the fiscal crisis that faces our country. >> and now the democrat-controlled senate hasn't really passed a budget resolution during the obama administration ever. but even before the house approved the new -- no budget, no pay measure.

harry reid said he would bring it up and intends to pass it it watch. >> but to spare the middle class another knockdown, drag out fight we're going to proceed to work on this legislation and get it out of here as quickly as we can. >> i also want to give credit where credit is due. and i thank speaker boehner for his leadership in diffusing a fight over the debt ceiling debate. >> 86 house democrats went along with boehner in the bill. 33 republicans opposed it as insufficiently conservative, shep? >> shepard: this doesn't stop the fight though, carl. it just puts it off for a while, right? >> yeah, in the short-term it did i investigators default by exceeding the nation's borrowing limits. there has been no reduction in spending or the deficits. if that happens in the upcoming budget phase, everybody wins but it hasn't happened in washington for years. spending has been going up and there hasn't been a balanced budget since the 1990s. >> shepard: a balanced budget indeed. carl cameron, thanks very much. we have learned that the risk lung cancer has gone up

>> shepard: an alarming new study out today, it shows the risk of lung cancer has skyrocketed among women. and scientists say it's because they are now smoking more like men, starting earlier and smoking more often. according to this report, in this week's new england journal of medicine, back in the 1960s, women who smoked regularly were 2.7 times more likely to die of lung cancer than people who hardly ever smoked. but between 2000 and 2010 that number

cancer. when you look at the changes over time, the numbers really are shocking. first of all, let's expand on that statistic you talked about. back in the 1960s a woman who smoked back then was 2.7 more times to die from lung cancer than a woman who smoked. nowadays that number has jumped up to 25.7 times more likely to die from lung cancer. other diseases, chronic obstructive pulmonary disease including emphysema. a woman who smoked four times more likely to die than a another woman who never smoked four times more. that number now 22.3 times higher. fewer women smoked in the 1960's, they smoked less and they tended to start smoking at a later age. all of that has changed now. and according to dr. lind lichtenberg of the american
